Terms of Service

"The Friendly Help Group" attempts to make all reasonable efforts to maintain an informative, useful, and safe website for the benefit of the general public. Please note that you will be referred to as "User" in this Agreement. The term "Provider" includes "The Friendly Help Group" and its officers, directors, employees, agents, successors, and assigns. The term "educator/coach" is used in the Terms and Conditions and on http://friendlyhelp.homestead.com (the "Site") and refers to the professionals who provide responses to User requests.

1. Services and Conditions of Use

The Friendly Help Group (the "Provider") will attempt to provide you (the "User") upon request with educational and supportive responses from educators/coaches.  You must be at least 18 years of age to participate.  We reserve the right not to respond at our discretion.  The service provided is subject to the terms of this Agreement. Provider reserves the right to modify this Agreement at any time by providing notice through the Site. You hereby agree that, at all times that you use the Site, you will abide by the Terms and Conditions set forth herein. To use the Site, you as User must agree to all of the Terms and Conditions set forth in this Agreement. You should read this Agreement carefully. Do not use the Site unless you have read and agree to abide by the Terms and Conditions set forth herein.

2. General Disclaimer

The content on the Site is provided for general information purposes only.  While this site has been established to assist those in need of, or those who may otherwise desire assistance, it is not intended to serve as a replacement for professional medical or clinical advice. The content offered on the Site or provided via email should not be used for diagnosis or treatment of a mental or medical condition. Do not disregard professional advice or delay seeking professional advise as a result of something you have read on the Site or receive via email.

User's reliance on any information provided on the Site or via email is solely at the risk of the User.  Opinions expressed on the Site or via email are solely the opinions of the authors of such material posted or appearing on the Site or sent via email. Provider does not assume any liability or responsibility for the accuracy of the content of any material provided on the Site or sent via email. Provider does not assume any liability or responsibility for damage or injury to persons or property arising from the use of any information or material of any nature provided on the Site or via email. Provider reserves the right, at any time, to modify or to stop providing any component or feature of the Site.

3. Privacy Statement

All personal information is otherwise private, and will not be made available to any external party, company, other user of the Web site, other person, or other entity in general without the express consent of the user. The staff of the Provider accesses user information only for legitimate, authorized administrative purposes.

There are three important exceptions to our assurances of confidentiality:

a.  United States law requires that any suspicion of risk of child or elder abuse be reported to welfare authorities or law enforcement authorities. If a professional believes that a child or elder is at risk of being abused, has already been abused, or that someone who previously abused children or elders is still a threat, they will often make an effort to report it to social services agencies and/or the police.

b.  Most United States courts have the power to subpoena our records and a professional's records if you are involved in a court case in which your relationship with the Provider is somehow relevant. Although this may be rare, if you have any questions, it is better to contact your lawyer prior to disclosing any information you may deem private.

c.  If someone's life is in danger, the Provider may choose to report it. This applies to potential cases of suicide or homicide.

At any time when a user contacts the Provider to make a query, suggestion, or comment, the user will not be subject to receiving any communications other than the response(s) to the initial question or comment, unless specifically requested by the user (e.g., no user will ever be defaulted into receiving any secondary or promotional material as a result of the contact).

The Site may contain links to other Web sites. However, this Privacy Statement applies solely to the use and disclosure of information collected by the Provider on this Site.  The Provider does not assume any responsibility or liability associated with the privacy practices of such other sites. The privacy policies of sites other than the Provider's may differ from the terms of this Privacy Statement and we encourage our users to carefully read and review the privacy statements of all sites on which they provide Personally Identifiable Information.

It is important to note that the Internet is not a completely secure environment. All communication will, to the greatest extent practicable, be treated in a confidential manner. Data provided will be handled according to the Provider's privacy policy, and will not be intentionally released, nor will identifying information be otherwise disclosed, except as stipulated in the above privacy policy. Use of this site constitutes an understanding and acceptance of the foregoing provisions.


4. Limitation of Liability and Warranties

THE SITE AND ALL CONTENT AND MATERIALS ON THE SITE ARE PROVIDED ON AN "AS IS" BASIS. USER AGREES TO USE THE SITE SOLELY AT USER'S OWN RISK. TO THE FULLEST EXTENT PROVIDED BY LAW, PROVIDER DISCLAIMS ANY AND ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES RELATING TO THE QUALITY, ACCURACY, OR CONTENT OF ANY AND ALL MATERIAL, INFORMATION, PRODUCTS, OR SERVICES POSTED ON OR ACCESSED THROUGH THE SITE, AS WELL AS ANY WARRANTIES OF TITLE OR OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Provider is not liable for the conduct of third parties and the risk of injury from the foregoing rests entirely with User.

Provider is not liable for damages of any nature including, without limitation, direct, indirect, incidental, consequential, or special damages arising out of User's use of the Site or inability to access or use the Site or out of any breach of any warranty.

5. Interactions with Professional Educators/Coaches

If you choose to interact with a professional educator/coach, your relationship is strictly with that person and the Provider is not involved in any way with that relationship. Provider does not endorse or recommend any professional.

User acknowledges that the professional educators/coaches are not employees or agents of Provider and Provider assumes no responsibility for any act or omission of any professional. User understands and agrees that, although a professional may have been contacted through information provided through the Site, Provider cannot predict or assess a professional's competence and appropriateness for User's needs. User also understands that User takes full responsibility for the decision to access a professional through the Site and to continue to interact with the professional.

User hereby releases and agrees to hold harmless the Provider, its directors, officers, employees, agents, successors, advisors, consultants, and assigns from any and all causes of action and claims of any nature resulting from the acts of professionals accessed through the contact information obtained through the Site.

6. Links to Other Sites

The Site contains links to other websites, sometimes called "third party" websites. Provider is not responsible for the content of linked third party sites and does not make any representation, warranty, or endorsement with respect to any content or material or the accuracy of any content or material on such third party websites.

7. Notice

Provider may give notice to Users by means of a general notice on the Site. User may give notice to Provider; such notice shall be deemed given when received by provider at any time by electronic mail to thefriendlyhelpgroup@gmail.com.

8. Indemnification

User agrees to indemnify and hold Provider harmless from any dispute that may arise from a breach of the terms of this Agreement. User agrees to indemnify and hold harmless Provider from any cause of action, claims and expenses, including reasonable attorney's fees and court costs, related to a violation of this Agreement, and its Terms and Conditions and as a result of any information, material, or content placed on the Site by User.

9. Merger Clause

This Agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes any and all other agreements, communication (written or oral) between Provider and User. Provider may amend this Agreement or impose new conditions at any time by notice from Provider to User as published through the Site. Any use of the Site by User after such notice shall be deemed to constitute acceptance by User of such amendments, modifications, or new conditions.
